Can foreigners buy property in Azerbaijan?

Buying as a
foreigner

Updated: September 2026

Short answer: yes. Foreigners and stateless persons can acquire ownership of apartments and other buildings in Azerbaijan. Land, however, is not transferred to them as property — it is available only on lease. This page is general information based on official sources.

What does the law say?

According to official information from the Ministry of Foreign Affairs, foreigners' ownership of real estate other than land is governed by the Land Code, Article 17 of the Law “On the legal status of foreigners and stateless persons” and the Housing Code:

  • foreigners can acquire land only by lease (Land Code, Articles 48.3 and 86.4);
  • when buildings are sold to a foreigner, the land plot beneath them is leased to the buyer (Land Code, Article 88.4);
  • ownership rights are registered in the State Register of Real Estate (Civil Code, Articles 139.1 and 139.3), and the contract is notarised (Article 144.1); the right to dispose of the property arises once it is registered.

Property and residence permits in Azerbaijan

According to the State Migration Service, owning real estate in Azerbaijan is one of the grounds for a residence permit:

  • temporary residence permit — real estate worth at least 100,000 AZN (Migration Code, Article 45.1.3);
  • permanent residence permit — real estate worth at least 200,000 AZN (Migration Code, Article 52.1.3).

The application must include an extract from the State Register of Real Estate and a valuation by a licensed appraiser (migration.gov.az). So you can apply only once your ownership is registered — for a new-build apartment, usually after it has been handed over and registered. The official source describes a residence permit; it does not describe a “golden visa” or investor-visa programme. Check your own situation with a lawyer.
